STUDY/TRAINING COURSE AGREEMENT

I confirm that I will attend the training course(s) (the “Training Course”) as detailed below.

In addition to my salary being paid by James Lynch Transport (the “Company”) in respect of my attendance at the Training Course, the Company will also pay the course fee(s) together with the cost of any required and any core study/training materials (such as text books etc.) and expenses which all need to be evidenced by appropriate VAT invoices (or other acceptable evidence where VAT is not payable)(the “Costs”).

The costs will be notified to you on or around the end of each training year, so you are aware of your ongoing liability under this Agreement.

In consideration of the above, you agree that if your employment ceases (for whatever reason) after the Company has incurred any costs, you will be liable to repay some or all of such costs as detailed below.

You will repay the Company with regards to the costs as follows:

I undertake that should my employment with the Company cease (for whatever reason) during the training or within 24 months after the completion of the Training Course, I will refund to the Company a percentage (%) of the aforementioned costs based on the following scale:

- Up to 6 months after: 100%
- Over 6 months but less than 12 months: 75%
- Over 12 months but less than 18 months: 50%
- Over 18 months but less than 24 months: 25%

I undertake that should I leave my employment with the Company at any time prior to my completion of the Training Course, that I will refund to the Company the full amount of the Costs (including any examination fees, as appropriate) incurred up to the date my employment ceases (for whatever reason).

The Company reserves the right to treat each [module][level] of the Training Course as an individual Training Course within their own right so the above-mentioned scale can be applied to each such [module][level].

I agree that the Company has the right to deduct any sum due under this Agreement from my final pay or any outstanding payments due to me.

If my final pay or any other outstanding payments due to me are insufficient to meet the amount due under this Agreement, then I will repay the amount due as a private transaction within one month of my employment ceasing. I confirm that any such sum is a debt due to the Company. Should I fail to pay any such sum to the Company as detailed above, I will also be liable for any costs incurred by the Company in trying to recover the said sum from me.

I also agree that the Company has the right to make a deduction from my pay all or part of the costs where I fail to attend a Training Course on which I have been booked unless I am able to reasonably justify my failure to attend. Any decision will be at the discretion of the (Manager) and a Director of the Company.

I also agree that my study/training contract cannot be transferred to any other employer during my training period under this Agreement unless there are specific circumstances arising (including TUPE) and with the express approval of a director.
The Company will receive regular reports of your study progress and any deficiency in your performance or completion of work will be viewed by the Company as a serious matter and discussed with you to resolve any problems being encountered. Failure to achieve the improvement or the standards required may lead to disciplinary action and could result in your dismissal.

I have read and understand the terms and conditions stated in this Agreement and freely confirm my acceptance of them.
